Terms & Conditions

These Terms and Conditions ("Terms") form a binding agreement between you and GoFuel. Please read them carefully. By downloading, installing, or using the GoFuel mobile application (the "App") or any related service (together, the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

1. About these Terms

The Service is operated by La100e Labs inc. ("La100e", "we", "us", or "our"), a corporation incorporated under the laws of the Province of Quebec, Canada. GoFuel is a product of La100e Labs inc. These Terms apply to every user of the Service. They work together with our Privacy Policy, which explains how we handle personal information and is incorporated into these Terms by reference.

We may publish additional rules, guidelines, or policies for specific features. Where they apply, those rules form part of these Terms.

2. Who can use GoFuel

You may use the Service only if you can form a binding contract with us and are not barred from doing so under applicable law. The Service is intended for users in the province of Quebec, Canada. If you are a minor in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian. The Service is not directed to children.

3. The GoFuel service

GoFuel helps you find and compare retail fuel prices at gas stations, primarily in Quebec. Features may include a live map of stations and prices, a nearby price list, favorites, price-trend insights, estimated savings based on a vehicle tank size you enter, and optional push notifications about price changes.

The Service is provided for personal, non-commercial, informational use only. We may add, change, or remove features at any time. GoFuel is free to download and includes features you can use at no charge. Some features are offered through an optional paid subscription, as described in Section 4.

4. Subscriptions and purchases

GoFuel is free to download and to use for its core features. Some features are offered through an optional paid subscription ("GoFuel Premium"). The features included in a subscription, the available plans, and their prices are shown in the App before you buy, and may change over time. You must have reached the age of majority where you live (18 in Quebec) to purchase a subscription. If you are a minor, a parent or legal guardian must make any purchase for you.

Subscriptions are sold as auto-renewable in-app purchases processed by Apple through your Apple Account. By purchasing a subscription, you agree that:

• payment is charged to your Apple Account when you confirm the purchase;
• the subscription renews automatically for the same period at the then-current price, unless you turn off auto-renewal at least 24 hours before the end of the current period;
• your Apple Account is charged for renewal within the 24 hours before the end of the current period;
• you can manage your subscription and turn off auto-renewal at any time in your Apple Account settings (App Store, then your account, then Subscriptions). Cancelling stops future renewals; it does not by itself refund the current period; and
• if a free trial or introductory offer is provided, any unused portion is forfeited when you purchase the corresponding subscription, where applicable.

All payments are processed by Apple under Apple's terms. We do not receive or store your payment card details. Refunds, where available, are handled by Apple in accordance with Apple's policies, and refund requests should be made to Apple.

We may change subscription prices or the features included in a plan. Where we do, the change applies to future billing periods, and we will present the new price or terms before they take effect, as required by applicable law. If you do not accept a price change, you can cancel before it takes effect.

If you are a consumer in Quebec, you keep all rights granted to you by the Consumer Protection Act (Quebec) and other applicable consumer protection laws, including any rights regarding contracts that renew automatically. Nothing in these Terms limits or waives rights that cannot be limited or waived under those laws.

5. Fuel price information is indicative

Prices, station locations, distances, "savings" figures, trends, and similar outputs are derived from third-party data and from inputs you provide (such as your vehicle tank size). They are provided on a best-effort basis with no guarantee of accuracy, completeness, timeliness, or fitness for any purpose. You are solely responsible for any decision you make based on the Service, including any decision about where or when to buy fuel.

Some features, such as price-trend insights and any "best time to fill up" suggestion, are predictions based on past price patterns. Past patterns do not guarantee future prices, and fuel prices can move suddenly for reasons no forecast can anticipate, so these suggestions may be wrong. They are general guidance, not financial advice, and you remain responsible for deciding when and where to buy fuel.

6. Third-party data and links

Fuel pricing and station data are sourced from third parties, including the Régie de l'énergie du Québec. GoFuel is not affiliated with, endorsed by, or sponsored by the Régie de l'énergie du Québec, Apple, any fuel retailer, or any brand shown in the App. Brand names, logos, and trademarks belong to their respective owners and are used only to identify stations.

Fuel price data originates from Régie essence Québec, the official price platform operated by the Régie de l'énergie du Québec. Under Quebec's Petroleum Products Act (as amended by the Act to ensure the responsible governance of energy resources, 2025, chapter 24), fuel retailers covered by section 67.1 of that Act must report any change to their posted prices for regular gasoline, premium gasoline, and diesel, and have a short window (currently five minutes) to do so. GoFuel reads this published data and refreshes on a similar cadence, which is why prices in the App update roughly every five minutes. GoFuel is an independent application; it does not collect prices from retailers itself and is not the official source. Prices may still be delayed, averaged, or rounded, so confirm at the pump (see Section 5).

Map data and related services may be provided by Apple Maps or other providers and are subject to their own terms. The Service may contain links to third-party websites or resources that we do not control. We are not responsible for the content, products, or practices of any third party.

7. Your device and local account

GoFuel works without you creating a username or password. To sync your settings and favorites and to deliver notifications, the App may create an anonymous account identifier tied to your device or installation. You are responsible for activity that occurs through your device and for keeping your device secure. If you delete and reinstall the App or change devices, some data may not carry over.

8. Acceptable use

You agree not to:

• use the Service for any unlawful, harmful, or fraudulent purpose;
• use the Service, or interact with your device, while driving or otherwise operating a vehicle, or in any way that distracts you from the road;
• copy, scrape, harvest, mass-download, resell, redistribute, or commercially exploit any data, content, or output of the Service;
• reverse engineer, decompile, disassemble, or attempt to extract source code, except to the extent this restriction is prohibited by law;
• interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service, our servers, or any related systems or networks;
• use automated means (bots, scripts, crawlers) to access the Service without our prior written consent;
• remove, obscure, or alter any proprietary notices; or
• use the Service in any way that infringes the rights of others or violates applicable law.

9. Notifications

If you enable notifications, GoFuel may send push notifications about price changes at stations you select. Notification delivery depends on Apple Push Notification service, your device, and your network, and is not guaranteed. Notifications are informational and may be delayed or missed. You can turn notifications off at any time in the App or in your device settings.

10. Intellectual property

The Service, including the GoFuel name, logo, design, text, graphics, and software, is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, solely for your personal, non-commercial use. We reserve all rights not expressly granted.

11. Apple App Store terms

The following applies if you obtain the App through the Apple App Store. These Terms are between you and La100e Labs inc. only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App, and any claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are our responsibility, not Apple's.

Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties. Your use of the App must also comply with Apple's applicable usage rules and Licensed Application End User License Agreement.

12. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any information (including fuel prices) is accurate, complete, or current. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you, and you may have rights that these Terms cannot limit. In particular, if you are a consumer in Quebec, nothing in these Terms excludes or limits the legal warranty of quality or any other legal warranty owed to you under the Consumer Protection Act (Quebec) and the Civil Code of Québec.

13. Limitation of liability

To the maximum extent permitted by applicable law, La100e Labs inc. and its directors, officers, employees, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, savings, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service, including any reliance on fuel prices or other information shown in the App, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our total aggregate liability for all claims relating to the Service will not exceed the greater of the amount you paid us (for example, through a GoFuel Premium subscription) in the twelve months before the claim, or fifty Canadian dollars (CAD $50). This cap is a token minimum for a service that is free for most users; it does not apply where the law does not allow it. Nothing in these Terms excludes or limits liability for bodily or moral injury, for fraud or fraudulent misrepresentation, for gross or intentional fault, or any other liability that cannot be excluded or limited under applicable law, including the Civil Code of Québec and the Consumer Protection Act (Quebec).

14. Indemnification

You agree to indemnify and hold harmless La100e Labs inc. and its directors, officers, employees, and agents from any third-party claims, damages, liabilities, costs, and expenses (including reasonable legal fees) to the extent they arise out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party. This does not apply to the extent a claim results from our own fault or negligence.

15. Changes to the service and these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide notice in the App. Changes take effect when posted. Your continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree, stop using the Service.

16. Suspension and termination

You may stop using the Service at any time and delete the App. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or to protect the Service or other users. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

17. Governing law and language

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. Before starting any formal proceeding, we ask that you first contact us through our support email so we can try to resolve the matter informally. The courts of the Province of Quebec, judicial district of Montréal, have jurisdiction over any dispute relating to the Service. If you are a consumer in Quebec, nothing in these Terms requires you to submit a dispute to arbitration, prevents you from bringing or joining a class action, or removes your right to bring proceedings before the courts of Quebec, as protected by the Consumer Protection Act.

These Terms are provided in English and French. A French-language version is available at terms-fr.html. If there is any discrepancy between the two versions, the French version prevails for residents of Quebec.

18. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.

We are not responsible for any failure or delay in providing the Service caused by events beyond our reasonable control, including natural disasters, power or network failures, outages or changes at Apple, Cloudflare, or other providers, interruptions in third-party data feeds (including the Régie de l'énergie du Québec), labour disputes, or government actions.
