Terms & Conditions

These Terms and Conditions (the “Terms”) are a contract between you and La100e Labs inc. governing the GoFuel mobile application and related services (together, the “Service”). Please read them before expressly accepting them. Use of the Service requires your agreement to these Terms. You may save a copy.

1. Agreement and operator

GoFuel is operated by La100e Labs inc. (“we”, “us” or “our”), a Québec business corporation registered under Québec enterprise number 1181898603, with its establishment at 220-9150 boulevard de l’Acadie, Montréal, Québec H4N 2T2, Canada.

These Terms apply together with our Privacy Policy. The Privacy Policy explains our personal-information practices but does not reduce your rights under these Terms or applicable law. Accepting these Terms does not constitute consent to optional analytics, marketing or sensitive-information processing. La100e Labs inc.’s Privacy Officer handles privacy requests concerning GoFuel through the contact details below.

2. Language

A complete French version of these Terms is available. Where Québec’s Charter of the French language applies, the French version will be provided first. You may then expressly choose to be bound by the English version. Opening an English page or changing the interface language does not constitute an express choice to contract in English. The version expressly selected by you governs, subject to rights that cannot be waived.

3. Eligibility

GoFuel is intended exclusively for the Québec market. You must be at least 14 years old to use GoFuel. If you are under the age of majority where you live, a parent or legal guardian must authorize your use and must make any purchase for you. You must be legally permitted to use the Service and provide accurate information when requested.

4. The Service

GoFuel helps users find and compare fuel prices, view stations and price trends, save preferences and favourites, record fill-ups, estimate fuel-related costs or savings, and receive optional notifications. Features may vary by location, device, subscription and release.

The Service is for personal, non-commercial and informational use. It is not an emergency, navigation-safety or financial-advice service.

5. GoFuel Premium

Some features require an optional auto-renewable subscription called GoFuel Premium. The App Store purchase screen shows the current product, price, currency, billing period, trial or introductory offer, and included features before you subscribe.

• Apple processes payment through your Apple Account. We do not receive your payment-card information.
• Your subscription renews automatically unless you cancel it in your Apple subscription settings before renewal.
• Apple determines billing, renewal, cancellation and refund processing under its rules and applicable consumer law.
• Cancellation stops future renewals but does not automatically create a refund for the current billing period.
• Deleting or suspending your GoFuel account does not cancel GoFuel Premium. You must manage the subscription separately through Apple.

We may change GoFuel Premium’s features or prospective price. Apple will present subscription price changes as required. We will not remove or limit any non-waivable rights under Québec’s Consumer Protection Act or other applicable law.

6. Fuel-price information

Fuel data includes information made available through Régie essence Québec. Retailers covered by Québec’s applicable reporting regime must report price changes in real time, but statutory exemptions exist. GoFuel is an independent application, is not endorsed by the Régie de l’énergie, and is not the official data source. GoFuel generally refreshes its copy of available data approximately every five minutes; that interval is GoFuel’s technical cadence, not a retailer’s legal reporting deadline.

Predictions and “best time” insights are estimates based on historical patterns. Past patterns do not guarantee future prices. You assume responsibility for decisions made using the Service.

7. Location and notifications

Nearby-station features may require iOS location permission. If you choose optional location-triggered notifications, you must enable them through an explicit action in GoFuel and grant the relevant iOS permissions. These triggers are enabled separately on each device and may be disabled at any time.

If home-based alerts are offered and you choose to configure them, Apple may process the address you search to return coordinates. GoFuel synchronizes the resulting latitude and longitude, the street line, and the name you gave the place or the city we fill in when you leave it blank, so a place you saved on one device is identifiable on the others, and to select and time the notifications you request. GoFuel does not use home coordinates to track journeys, advertise to you or sell information.

Notifications may be delayed, missed or inaccurate because they depend on data feeds, Apple services, device settings and network availability. Do not rely on them for emergencies or safety-critical decisions.

8. Your account and data

GoFuel may automatically create a Supabase account without an email address to synchronize settings and requested features. Its generated identifier links records to your account; those records remain personal information. You are responsible for securing your device. Our handling of account identifiers, settings, home coordinates, favourites, fill-ups, notification tokens, diagnostics and subscription status is described in the Privacy Policy.

You may request account deletion through the method available in the App or by contacting our Privacy Officer. A valid request suspends normal account use immediately and starts a 30-calendar-day cancellation period. You may cancel at any time before that period ends. Permanent production deletion begins automatically after the period ends; the in-app process does not offer accelerated deletion. You may contact the Privacy Officer to exercise applicable legal rights. This cancellation period does not postpone an earlier deletion required by law or extend statutory response deadlines. Backup copies have a reference retention period of 180 days from creation for security and restoration. Some older copies remain subject to longer existing storage locks and are deleted through the applicable expiry and cleanup process. This is not a guarantee of erasing every copy within 180 days of a request. Access is restricted; recorded deletion requests must be reapplied after restoration before normal use resumes. Processor deletion and records retained by law follow their applicable rules, as described in the Privacy Policy.

9. Acceptable use

You must not:

• use the Service unlawfully, fraudulently, harmfully or while operating a vehicle;
• scrape, harvest, mass-download, resell, redistribute or commercially exploit Service data;
• reverse engineer or attempt to extract source code except where the law prohibits this restriction;
• circumvent subscription controls, security, rate limits or access restrictions;
• interfere with the Service or access systems or data without authorization;
• use automated access without our written permission; or
• infringe intellectual-property, privacy or other rights.

10. Intellectual property

GoFuel’s software, name, logo, design and original content belong to La100e Labs inc. or its licensors. Subject to these Terms and Apple’s applicable licence terms, you receive a limited, personal, non-exclusive, non-transferable and revocable right to use the App for personal purposes. Fuel retailers’ and other third parties’ marks belong to their respective owners. Identifying a station does not imply endorsement.

11. Apple terms

The App is licensed under Apple’s applicable Standard Licensed Application End User License Agreement. These Terms are between you and La100e Labs inc., not Apple. Apple does not operate GoFuel or provide its support. Apple and its subsidiaries are beneficiaries of the provisions applicable to Apple-distributed software and may enforce them. Your use must comply with App Store usage rules and applicable third-party terms.

12. Warranties and liability

Except for warranties and remedies that cannot lawfully be excluded, the Service is provided “as is” and “as available”. We do not promise uninterrupted availability or that prices, locations, forecasts, notifications or other information will always be complete, current or accurate.

Nothing in these Terms excludes or limits liability for bodily or moral injury, intentional or gross fault, fraud, or any legal warranty or consumer remedy that cannot be excluded under the Civil Code of Québec, the Consumer Protection Act or other applicable law.

13. Changes to the Service or Terms

We may change features, technical requirements, acceptable-use rules, third-party integrations, contact details and prospective subscription administration as the Service evolves. We cannot unilaterally change an essential element where applicable law prohibits it. The revision date identifies this text; it does not replace any notice, acceptance or effective date required for an existing contract.

Where Québec consumer law requires notice of a contractual amendment, we will give written notice at least 30 days before it takes effect. The notice will show the previous and amended provision, the effective date, and your right to reject the amendment and cancel the affected contract without cost where the amendment increases your obligations or reduces ours. The applicable refusal and cancellation right may be exercised by sending us notice no later than 30 days after the amendment takes effect, without fees, penalties or cancellation indemnity. Material changes may require renewed express acceptance. Merely posting a change does not waive these protections.

14. Suspension and termination

You may stop using GoFuel at any time. We may limit or suspend access when reasonably necessary to address a breach, fraud, security risk, legal requirement, discontinued service or threat to users or systems. Where appropriate, we will provide notice and an opportunity to address the issue. Ending GoFuel access does not itself cancel an Apple subscription.

15. Governing law

These Terms are governed by Québec law and the federal laws of Canada applicable in Québec. Québec consumers retain the jurisdiction, remedies and protections that applicable consumer law makes mandatory. These Terms impose no advance mandatory arbitration or class-action waiver. Nothing requires a consumer to waive a right to bring a claim before a competent court.

16. General

If a provision is unlawful or unenforceable, it will be limited or severed only to the extent necessary, and the remainder will continue. A failure to enforce a provision is not a waiver. Provisions concerning ownership, accrued payment obligations, lawful retention, liability and dispute resolution survive where their nature requires.

We are not responsible for delay caused by events reasonably beyond our control, but this does not remove obligations or remedies that cannot be excluded by law.
